Big Names Looking To Enter Spanish Online Casino Gambling Market

Anytime a new major online gambling market opens up, the big names in the industry are going to attempt to be the first ones in. That is what is happening in Spain, where Bwin and William Hill want to corner the Spanish market.

Spain has been in a similar position as the US recently regarding their online gambling laws. The Spanish government, however, is moving quicker towards correcting their European Union violations and legalizing online gambling in the country.

That effort has prompted two of the biggest online gaming operators in the world to begin negotiations for licensing deals. The two companies are trying to get a piece of the nearly fifty million potential customers in the Spanish market.

“If an online gaming company wants to grow, certainly the Spanish Internet gambling market would be one to go after,’ said observer Kelly Gray, “next to the US, the Spanish market could end up being one of the biggest online gambling markets in the world.”

The US market is considered to be the biggest in the world, even though online gambling is currently illegal in the country. Lawmakers in the US are also working on developing a legalized, regulated Internet gambling industry.

Should the US market open up, it would be likely that many current land based casino companies would get preferential treatment when it comes to licensing. There will be pressure, however, to license some foreign companies to keep up with European Union commitments.

Gts signs games agreement with Gala Coral

Menendez Online Casino Bill Could Help Barney Frank Effort

Lawmakers in the Senate can now be added to the growing number of people that are calling for changes to online casino gambling laws. Senator Robert Menendez will soon be introducing a Bill that will be similar to the one Representative Barney Frank has introduced in the House.

To have both chambers working on Internet gambling legislation should speed up the process of overturning the Unlawful Internet Gambling Enforcement Act. The law was passed back in 2006, but has come under heavy criticism of late.

Rep. Frank has been trying to have the law overturned for several years. His efforts last year were shot down by fellow lawmakers, but this time he has support on both sides of the aisle. The public is crying out to these lawmakers to change the online gambling laws.

Senator Menendez would like the laws changed so that online gambling would become legal and the industry would be regulated. It is the same goal as Frank, and having two separate pieces of legislation going at the same time might actually help the issue get resolved quicker.

If the House passes their version, and the Senate passes their version, then the two would only have to tweak the two Bills to come up with a finished product. With Frank’s House Financial Committee dealing so heavily with the economy, the gambling Bill of Menendez may move quicker through the approval process.

Playtech prevails in patent case

One of the industry’s largest online gambling software developers, Playtech plc, found itself among several companies named in a patent hearing in the UK in June and July. The case against the companies ultimately failed when the plaintiff’s patent was adjudged to be invalid.

Case number HC07C03466 was heard in the Patents Court in the High Court of Justice, Chancery Division in London before The Honourable Mr. Justice Lewison and pitted an Isle of Man company titled Cranway Limited (the plaintiff) against Playtech Cyprus Ltd., Playtech Software Ltd., Techplay Marketing Ltd., PTVB Management Ltd., Tote Credit Ltd., Totesport NV., and Totesport Alderney Ltd.

Appearing for Cranway were Michael Tappin QC and Brian Nicholson (instructed by Herbert Smith LLP), whilst the defendant companies were represented by Daniel Alexander QC and Adrian Speck (instructed by Linklaters LLP) over five hearing dates in June 2009 and one in July this year.

In introducing the case, the judge summarised Cranway’s claim, saying that the company claimed its patent for online gambling (EP 0625760B1) had been infringed by Playtech and the Tote. It was not necessary to distinguish between the various Playtech corporate entities or between the various Tote corporate entities, he commented.

“The invention relates to an interactive, real time, realistic ‘home’ computer gaming system using general purpose computers. Aspects of the invention concern auditing and security to ensure fairness for players and prevent players defeating the outcome of a game; fast, efficient communication to enable reliable, low cost, real time, realistic operation; accounting; and enabling players to play a variety of games,” he said.

“Playtech and the Tote deny infringement; but also say that the patent is invalid for three reasons:

  1. The claimed invention is not new;
  2. The claimed invention is obvious;
  3. The claimed invention is not in fact an invention.

Both sides called expert witnesses; in Cranway’s case Stacy Friedman, a casino game designer and inventor, computer software systems engineer, and gaming mathematician. Playtech presented Professor Ian Leslie, Professor of Computer Science at the University of Cambridge Computer Laboratory.

Leslie pointed out that the patent in question is written in very basic terms with little or no explanation of the details of the systems it describes or how they might be implemented: it is concerned with the functionality of the system rather than details of its design.

Cranway described the patent as: “This invention relates to an interactive, real time, realistic “home” computer gaming system using general purpose computers. Aspects of the invention concern auditing and security to ensure fairness for players and prevent players defeating the outcome of a game; fast, efficient communication to enable reliable, low cost, real time, realistic operation; accounting; and enabling players to play a variety of games.”

After extensive argument by both sides the claim failed as the patent was ruled invalid.

2009 British Open: Other Bets to Consider

The 2009 British Open doesn’t have to be just about betting on who the winner will be (albeit the payout can be extraordinary).   Numerous other bets are being offered in conjunction with the British Open.

Sergio Garcia is widely considered the one to beat after Tiger Woods by most oddsmakers so no surprise he would be listed as the favorite here with a payout potential of US$900 for every US$100 bet.

Henrik Stenson and Martin Kaymer each had 14/1 odds.  Ross Fisher had 16/1 odds.

Here is what we at Gambling911.com find quite shocking:  Padraig Harrington (who has won the British Open the last two years) is getting absolutely no love from the oddsmakers.  They had him with 18/1 odds of being the top European.  Go figure.

Odds to win the 2009 British Open have been updated as of Sunday night with many changes taking place and online sportsbook lines varying across the board.   At the time of publication, a large majority of betting shops were still not offering odds on the 2009 British Open or had taken them down temporarily. 

Tiger Woods – Now would pay US$240 for every US$100 bet at Sportingbet.com.  They do not accept U.S. gamblers at this time however. Sportsbook.com had Woods paying $200 for every $100 bet. Padgraig Harrington -  Would pay out US$3000 for every US$100 bet at Sportsbook.com Sergio Garcia – Both Sportsbook.com and Sportingbet.com pay US$2000 for every US$100 bet.

Jim Furyk – Sportsbook.com price is +3000 for a US$3000 payout on a US$100 bet. Paul Casey –  Pays $2500. Rory McIlroy –  Pays $2500 at Sportingbet.

Ian Poulter –  Pays $3500 for every $100 bet at BetUS.com

Lee Westwood – Pays $3000 at Sportsbook.com

Motion for Return of Property Filed in Online Poker Seizure Case

A payment processor whose funds had been seized as part of a US Attorney Southern District of New York action has now filed a Motion for Return of Property, Gambling911.com can report exclusively.

Account Services Corporation, through counsel, respectfully moves this

Court to order the return of funds seized from Wells Fargo Bank ("Wells Fargo"),  account number 7986104185, and from Union Bank, N.A. ("Union Bank"), in  accounts numbered 353000248 and 353000256, pursuant to FED. R. CRIM. P. 41(g). 

Alternatively, counsel requests that this Court conduct an Evidentiary Hearing on  the issues raised by this Motion. 

As part of the background, Account Services Corp states the following:

Internet poker is a popular and widespread leisure activity in the United

States.  At least 10,000,000 Americans play internet poker, and some estimates set  that figure substantially higher.  Operators of online poker websites (collectively,  "operators") offer internet poker players the option of either playing with "play  money" (online credits) or "real money" (legal currency).  If a player chooses to  engage in wagering with real money, the player must deposit his or her funds into  an account with an operator or an operator-designated third-party processor.  At all  times, the money on deposit is owned and controlled by the player.  The funds are

merely held in trust for the benefit of the player and released upon the player’s  request.  See, e.g., PokerStars End User License Agreement.

The complaint also states the following:  

Here, continued retention of the funds from ASC’s Wells Fargo and Union

Bank accounts would be patently unreasonable and this Court must therefore order that the funds be returned.  As discussed above, the seizure violated ASC’s Fourth and Fifth Amendment rights: in the case of the Union Bank accounts, the funds were simply seized without a warrant or notice.

The filing was delayed a day.
